Defenses in DUI/DWI Cases

There are times when you can’t afford a DUI/DWI conviction. This is especially true if you have one or more past convictions. As your lawyer, I will look for ways to mitigate penalties and evaluate possible defenses.

Police must have a reason to stop you. Once they stop you, they have to have a reason to believe you are intoxicated before they can give you the Breathalyzer test. The accuracy of the Breathalyzer tests can also be challenged.

Your DMV Hearing

If you are arrested on drunk driving charges in Delaware, you will face an administration drivers license suspension hearing. This hearing is separate from your criminal DUI case and only concerns your driving privileges. As your lawyer, I can cross-examine the arresting officer and search for defenses in your criminal case.
